Aamey Terms of Service
This Terms of Service ("Terms", "Agreement") is provided by Joorus Inc. ("Joorus", "we", "our", "us").

Important: these Terms are a binding legal contract. By creating an Aamey account, using the Aamey app or website, or accessing any Aamey service, you agree to these Terms. If you do not agree, do not use Aamey.

1. Definitions
- "Aamey" — the Aamey beauty platform, including iOS app, Android app, website (aamey.com), kiosk app, MUA storefronts, magazine service, and any related Joorus services.
- "User", "you", "your" — any person or entity using Aamey.
- "Content" — text, images, video, looks, sketches, profiles, reviews, comments, and all other material submitted to or generated within Aamey.
- "Services" — all features and functionality offered by Aamey.
- "Marketplace Partners" — third-party retailers (Amazon, eBay, AliExpress, Alibaba, Shopify-based stores, Sephora, Ulta, brand DTC sites) from whom Joorus sources products on your behalf.
2. Eligibility and accounts
2.1. You must be at least 13 years of age. If you are between 13 and the age of majority in your jurisdiction (18 in most regions; 19 in some Canadian provinces; 21 in some US states), you may use Aamey only with verified parental or legal-guardian consent.
2.2. You may not use Aamey if you are barred from doing so under the laws of any jurisdiction, including export-control, sanctions, or anti-money-laundering laws.
2.3. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
2.4. Joorus may suspend or terminate your account for violation of these Terms, fraudulent activity, or abusive behavior.
3. The Aamey services
3.1. AI-driven recommendations. Aamey uses AI to suggest products, looks, routines, and content. These suggestions are not medical, dermatological, or professional advice. Consult a qualified professional for any health, skin, or hair concern.
3.2. AR try-on and face analysis. Aamey may, with your explicit consent, capture face geometry and related biometric features to power try-on, personalization, and other features. See our Biometric Privacy Notice for details.
3.3. Magazine. Aamey offers an opt-in personalized digital magazine. Issues are generated using your likeness only with your explicit, separate consent. See the AI & Likeness Consent.
3.4. Marketplace agency. When you order a product through Aamey, you authorize Joorus to act as your buying agent and to purchase that product from a Marketplace Partner using Joorus's account, ship to the address you provide, and invoice you. See the Marketplace Agency Agreement.
3.5. MUA marketplace. Aamey enables you to discover and book makeup artists ("MUAs"). MUAs are independent contractors, not employees of Joorus.
3.6. Aamey Pro features. Some features are limited to professional tiers (MUA Pro, B2B, Institute). Verification of professional credentials may be required.
4. Payments, subscriptions, and refunds
4.1. Subscriptions and fees are listed at aamey.com/pricing and within the Aamey app. By subscribing or placing an order, you agree to the stated price plus applicable taxes (GST/HST for Canadian customers; sales tax or VAT for applicable jurisdictions).
4.2. Stripe processes all payments. Joorus does not store full payment-card data. By providing payment information, you also agree to Stripe's terms.
4.3. Subscriptions auto-renew unless cancelled before the next billing cycle. Cancel at any time from in-app Settings.
4.4. Refunds for digital subscriptions are at Joorus's discretion outside statutory cooling-off rights.
4.5. Refunds for marketplace orders are governed by Section 7.7 of the Marketplace Agency Agreement and the original Marketplace Partner's return policy.
4.6. Failed payments may result in suspension of premium features until the balance is settled.
5. Your content and license
5.1. You retain ownership of Content you create or submit to Aamey.
5.2. By submitting Content, you grant Joorus a worldwide, royalty-free, non-exclusive, sub-licensable license to host, store, reproduce, modify (for technical purposes such as format conversion), display, perform, and distribute that Content for the purpose of operating and improving the Aamey services.
5.3. You will not submit Content that:
- Infringes intellectual-property rights;
- Is defamatory, harassing, hateful, or threatening;
- Violates privacy or publicity rights;
- Contains malware or attempts to compromise security;
- Promotes illegal activity;
- Is sexually explicit, particularly involving minors;
- Misrepresents identity or affiliation.

6. Aamey content and intellectual property
6.1. The Aamey app, website, brand, logos, and software are owned by Joorus and protected by intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute, or reverse-engineer them.
6.2. AI-generated content, including magazine renders, look suggestions, and editorial copy, is delivered to you under a non-exclusive personal license unless otherwise specified. You may not republish AI-generated Aamey content outside Aamey services without prior written permission.
6.3. MUA content is owned by the creating MUA, licensed to Joorus and to you under the terms set out in the MUA Platform Agreement.
7. Privacy and biometric data
7.1. Joorus's collection and use of your information is governed by the Privacy Policy and the Biometric Privacy Notice, both of which are incorporated into these Terms by reference.
7.2. Biometric data (face geometry, embeddings, dermatoscope images) is captured only with your explicit prior consent, retained for no longer than 24 months (or until you revoke), and used only for the purposes you authorize.
8. Disclaimers
8.1. AAMEY IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
8.2. Joorus makes no representation that Aamey will be uninterrupted, error-free, or that AI recommendations will be accurate.
8.3. Joorus is not responsible for Marketplace Partners' actions, product quality, shipping delays, or returns beyond what is set out in the Marketplace Agency Agreement.
8.4. No medical advice. Aamey is not a substitute for professional medical or dermatological advice.
9. Limitation of liability
9.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOORUS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE.
9.2. JOORUS'S TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED CANADIAN DOLLARS (CA$100), OR (B) AMOUNTS YOU PAID TO JOORUS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
9.3. Some jurisdictions do not allow limitations of liability; in those jurisdictions, Joorus's liability is limited to the maximum extent permitted by applicable law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Joorus and its affiliates from claims arising out of (a) your Content; (b) your use of Aamey in violation of these Terms; (c) your violation of applicable law; or (d) your violation of third-party rights.
11. Dispute resolution
11.1. Governing law. These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
11.2. Informal resolution. Before commencing any formal dispute, you and Joorus agree to attempt good-faith resolution by contacting [email protected] for at least sixty (60) days.
11.3. Binding arbitration (US users). Any dispute arising out of these Terms between Joorus and a US-resident User will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in San Francisco, California, with English as the language of the proceedings. YOU AND JOORUS WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
11.4. Courts (other Users). For Users outside the US, exclusive jurisdiction lies with the courts of Toronto, Ontario, Canada, except where local consumer-protection law requires otherwise.
11.5. Opt-out of arbitration. US Users may opt out of binding arbitration by emailing [email protected] within thirty (30) days of first accepting these Terms with the subject line "Arbitration Opt-Out".
12. Force majeure
Joorus is not liable for delay or failure caused by events outside its reasonable control, including natural disasters, war, civil unrest, government action, internet or utility outages, or third-party Marketplace Partner failures.
13. Modifications and termination
13.1. Joorus may modify these Terms by posting an updated version and notifying you in-app or by email at least thirty (30) days before material changes take effect.
13.2. Continued use of Aamey after modifications constitutes acceptance.
13.3. You may terminate your account at any time. Joorus may terminate or suspend your account for breach of these Terms.
13.4. Sections 5, 8, 9, 10, 11 survive termination.
